Center for Union Facts Rules for “Top Ten Worst Union-Protected Teachers” Program

  1. Nominations: Any person who is a legal resident of the United States who is thirteen (13) years old or older may submit nominations (this website is intended for adults; it does not knowingly accept and does not expect to receive any personally identifiable information -- name, address, etc. -- from persons under the age of 13). No person may submit more than three (3) nominations. No person may nominate himself or herself.
  2. How to Enter: You must enter through the entry page for this program. All fields except teacher’s district must be completed with the information required. Entries are limited to 150 words in the appropriate field (nominations may be edited by Center for Union Facts). Information identifying the nominee must be included in a teacher’s nomination, but we will remove all identifying information before publishing a nomination except with the teacher’s express written permission, as described below. The deadline for nominations will close on May 15, 2008 at 11:59:59 p.m. Eastern Standard Time.
  3. Eligibility Standards and Requirements: Every nomination for Worst Teacher will be screened before we publish it or consider it eligible for this program. Nominees must meet the following criteria:
    • must be under fifty (50) years of age
    • must be employed and expected to teach through the end of the normal 2007-08 school year
    • must be tenured teachers or the equivalent (as defined by state law)
    • must be unionized or covered under a collective bargaining contract
    • must NOT currently be undergoing administrative disciplinary procedures
    Any nominee determined by the Center for Union Facts not to meet these criteria will not be considered.
  4. Judging Criteria: To get a nominee in our “Top 10,” your anecdote must be true and reflect poor teaching skills or demeanor, such as stupidity, laziness, foolishness, or odd behavior. Any nomination that appears libelous, defamatory, untrue or an undue invasion of privacy will not be considered. Nominations that concern a teacher’s legitimate use of grading or discipline will not be considered. Interpreting and applying these criteria will be done exclusively by the Center for Union Facts, whose decisions are final.
  5. Verification: Contact information for the nominator must also be included, but we will not voluntarily publish any information disclosing your identity at any time. However, we will disclose information if required by law, such as subpoena or court order. If one of your nominees is selected as a “Top 10 finalist” by the Center for Union Facts, you will be required to submit evidence verifying the facts behind their nominations and eligibility criteria of the nominee, if needed. Center for Union Facts reserves the right to reject any Top 10 finalist if critical information can not be verified to its satisfaction.
  6. Winner Selection: After the close of nominations, the Center for Union Facts will determine up to ten (10) program finalists (ranked in the sole judgment of the Center for Union Facts) whose eligibility can be verified. Each finalist will be offered $10,000 in cash (offer expires June 30, 2008 at 11:59:59 p.m.) if he or she agrees permanently to resign or retire from any and all careers in education, including teaching or tutoring and if he or she signs, under penalty of civil law, a release agreeing to have his or her name and the reasons for his or her winning a Top Ten Worst Union-Protected Teacher award published by the Center for Union Facts. Each such winner must contractually agree that if he or she resumes a career in education, he or she will be liable to refund to the Center for Union Facts $10,000, plus interest and $5,000 in liquidated damages.
  7. Role of Nominators: This is not a “contest” for nominators and there will be no prize or consideration or other recognition for nomination of program finalists or otherwise. Except as required by law, nominators will not be identified. All entries become the exclusive property of the Center for Union Facts and nominators agree that they do not retain and will not assert intellectual property or other rights to entries, including any rights to further disseminate entries.
  8. Libel and Invasion of Privacy: Nominators who submit falsified entries or entries that invade one’s privacy will be subject to liability under the laws of their respective states, Virginia, and the United States.
  9. Limitation of Liability and Remedies: UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL THE CENTER FOR UNION FACTS OR AFFILIATED ENTITIES OR ITS SUCCESSORS OR ASSIGNS, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, OR EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF PROFITS OR HARM TO BUSINESS OR REPUTATION, ARISING OUT OF PARTICIPATION IN THE “TEN WORST UNION-PROTECTED TEACHERS” PROGRAM, POSTING ON OR ACCESS AND/OR DOWNLOAD OF ANY MATERIALS OR INFORMATION FROM ANY WEB SITE OWNED, OPERATED OR CONTROLLED BY THE CENTER FOR UNION FACTS OR AFFILIATED ENTITIES.
  10. Venue: Any disputes concerning the “Ten Worst Union-Protected Teachers” program that is not otherwise resolved shall be brought in the courts of Virginia and participants consent to personal jurisdiction and venue of such courts.
